Clements man taken into custody

A simple request to check the welfare of a 62-year-old rural Clements man escalated into an incident that brought law enforcement officers from Lyon County, the Kansas Highway Patrol and the Kansas Bureau of Investigation to assist Chase County officers.
According to Chase County Sheriff Richard J. Dorneker, the request to check the welfare of David Foley, 62, came on Monday.
Dorneker went to Foley’s home to see if he was all right.
“Upon sheriff’s arrival and making contact with the resident in Clements, a criminal act had occurred between Dorneker and the resident,” the sheriff said in a news release Tuesday afternoon.
Dorneker left the home to secure assistance in taking the man into custody.
The combined team of law enforcement officers returned to the residence later the same day.
“Upon arrival, the resident had stayed in the residence and was later arrested using less-than-lethal force,” Dorneker said in the news release.
Dorneker said in a telephone interview late Tuesday afternoon that Foley is in custody and has been charged with aggravated assault on a law enforcement officer.
The investigation is continuing into the incident.
