Judge sets December trial

Dec. 15 has been set as the trial date for Dwight Swafford, who is accused of intentional attempted second-degree murder in a shooting at the home he shared with the victim’s mother at 2507 Lincoln St.
District Judge Lee Fowler also set Dec. 1st at 10:30 a.m. for a hearing on a motion filed today by Swafford’s attorneys and Dec. 11 at 3:30 p.m. as the final pre-trial conference before the trial.
The dates were agreed upon during a pre-trial conference Friday afternoon in Fowler’s courtroom.
Swafford, 55, is accused of shooting his companion’s 29-year-old son, William M. Calvert, during an altercation at the home on Lincoln Street.
During court on Friday, Fowler granted a motion by Lyon County Attorney Marc Goodman to add Dr. Erik Mitchell of Topeka as an expert witness to the prosecution’s witness list.
Fowler will hear the defense motion on Dec. 1. It was filed Friday at 1:44 p.m., prior to the 2 p.m. pre-trial conference.
Swafford, who remains free on bond, is represented by Frederick Meier II and Bryan Williams.
